Terms and Conditions

Acceptance of Terms

Welcome to Jinko, a travel booking platform operated by Jinko Inc. (“Jinko,” “we,” or “us”).

These Terms and Conditions (“Terms”) govern your access to and use of Jinko’s services, including our mobile application and any conversational interfaces (such as our ChatGPT-powered messaging platform).

By accessing or using Jinko’s mobile app or chatbot service, you (“User” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (referenced below).

If you do not agree with any part of these Terms, you must refrain from using the Jinko platform or services.

Scope of Platform: Jinko provides a service to search for and book flight tickets through third-party travel providers.

Please note that Jinko’s platform does not include any user-generated content features (such as user posts or public reviews), and we do not offer any loyalty rewards programs or promotional offer schemes at this time.

These Terms cover the use of Jinko across all interfaces, including our mobile application and any integrated conversational or AI-based platforms.

Description of Services and Third-Party Bookings

Jinko’s Role: Jinko is a travel search and booking intermediary that allows you to find flight options and make bookings with third-party airlines or travel service providers.

Jinko is not an airline, travel agency, or direct provider of flights, and we do not control the travel services you book.

Instead, any flight, ticket, or travel service you reserve via our platform is provided by an independent third-party travel provider.

When you make a booking through Jinko, you are entering into a contract with the selected airline or travel provider — not with Jinko.

Jinko’s platform facilitates your interaction with these providers, but Jinko is not a party to the transport or service agreement between you and the provider.

The third-party provider (for example, the airline operating your flight or the ticketing agency issuing your ticket) remains solely responsible for the travel services and their fulfillment.

Third-Party Terms: Because your booking is ultimately with a third-party provider, that provider’s own terms and conditions (such as an airline’s Conditions of Carriage, fare rules, cancellation policies, or other applicable terms) will apply to your reservation.

You will be notified of the identity of the travel provider and presented with any key terms from the provider at the time of booking, and you should read and understand those terms before completing your booking.

In fact, to finalize a booking through Jinko, you must accept the applicable third-party provider’s rules and restrictions, including their payment requirements, cancellation policy, and refund terms, as part of the booking process.

Jinko does not recommend or guarantee any particular provider or service – listing a flight or provider on our platform does not constitute an endorsement by Jinko of that provider’s quality, safety, or reliability.

You agree that any travel services obtained via Jinko are provided by the third party, and not by Jinko, and that any questions, issues, or liability related to those services are the responsibility of the provider.

Jinko will assist you in contacting or interfacing with the provider as needed, but we cannot assume responsibility for the provider’s performance.

Platform Features: Jinko’s services are focused on travel search and booking.

As noted, the platform does not currently include features for users to publicly post content or feedback, and we do not run loyalty point programs or special promotional offer schemes.

Any future introduction of user content features, rewards programs, or promotions would be governed by additional terms, but unless expressly provided, none are available as of the effective date of these Terms.

Eligibility and User Accounts

Eligibility: Jinko is intended for use by individuals who are at least 18 years old and who have the legal capacity to enter into binding contracts for travel services.

By using our platform, you represent that you are 18 years of age or older (or the age of legal majority in your jurisdiction) and legally competent to agree to these Terms.

Our services are not marketed to or intended for children or minors.

If we discover that a person under 18 has provided personal data or attempted to book via Jinko, we reserve the right to cancel such bookings and delete any associated accounts or data.

Accounts: In order to access certain features (such as completing a booking or viewing past trips), you may need to create a user account with Jinko.

When registering an account, you agree to provide truthful, accurate, current, and complete information about yourself and any travelers for whom you are booking.

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

You agree to promptly notify Jinko of any unauthorized use of your account or security breach.

We may require you to verify your email or phone number and may suspend or terminate the account if we suspect any fraudulent or improper activity.

You agree to use your Jinko account and our platform solely for your personal, lawful travel booking purposes.

This means, among other things, that if you are booking on behalf of anyone else (such as family members or friends), you warrant that you have their authority to do so.

In such cases, you are responsible for ensuring that each traveler understands and agrees to the relevant provider terms and these Terms, and you accept responsibility for the booking on their behalf (including payment of fares or fees, making or conveying any changes/cancellations, and all other aspects of the reservation).

You further agree that all information you provide on behalf of others is accurate and that you have obtained any necessary consent to share their personal data for the purpose of booking (see “Personal Data and Privacy” below).

Account Use and Restrictions: You are responsible for all usage of the Jinko platform under your account.

You agree that you will not permit others to use your account except for the purpose of assisting with your own travel planning, and you remain liable for any usage by anyone you have given access to.

We reserve the right to suspend or terminate your account (or access to the platform without an account) at any time if, in our reasonable judgment, you violate these Terms or engage in any activity that might cause harm, fraud, or legal liability (to Jinko, our users, or providers).

Permitted Use of Platform (Mobile App and Conversational Interface)

By using Jinko, you agree to use our platform (whether via the mobile application or the conversational chat interface) in a responsible and lawful manner.

The Jinko platform, including any AI-based chat assistant we provide, is offered for your personal, non-commercial use in searching for information and booking travel.

You agree not to abuse the platform or use it for any purpose that is unlawful, prohibited by these Terms, or otherwise detrimental to Jinko or our partners.

In particular, when accessing Jinko (including through the ChatGPT integration or any messaging interface), you agree that you will NOT:

  • Make fraudulent or false bookings. You will not attempt to make any reservation under a false identity or with invalid payment information, and you will not book travel without a genuine intent to complete the travel or pay applicable charges (no speculative, false, or fraudulent bookings).

  • Misuse automated tools or extract data. You will not use any robot, spider, scraper, or other automated means to access the Jinko platform or gather content or information, nor will you attempt to monitor or copy our data by any automated process.

  • Likewise, you will not attempt to interfere with the proper working of our services by imposing an unreasonable load on our infrastructure (e.g. through mass queries or denial-of-service attacks).

  • Circumvent security or violate regulations. You will not attempt to bypass any security measures or access controls on our app or chat system.

  • You also agree to use the platform only for legitimate travel booking purposes in compliance with all applicable laws and regulations (for example, you will not use Jinko to engage in money laundering, harassment, or any fraudulent activity).

Third-Party Platform Rules: If you access Jinko through a third-party platform or service – for example, via a conversational chatbot interface integrated in a tool like ChatGPT – you agree to abide by all applicable terms of use of that third-party platform in addition to these Jinko Terms.

This means, for instance, complying with any usage policies of the chat service itself.

Jinko has no control over the terms or operations of third-party platforms, so please familiarize yourself with those requirements as well.

These guidelines are intended to ensure the platform remains reliable and safe for all users.

If we detect violations of the above rules or other misuse, we may take action including terminating or restricting your access to Jinko’s services without notice, as deemed appropriate.

Conversational Platform: Jinko’s conversational interface (such as our ChatGPT integration) is provided to enhance user convenience.

When interacting with the Jinko chatbot or AI assistant, you understand that you are communicating with an automated system designed to assist with travel inquiries.

We strive to ensure the chatbot provides helpful and accurate information;

however, you are ultimately responsible for verifying the details of your booking during the confirmation steps.

If you have any doubt or confusion about information provided via the chatbot, you should review the information in the app’s booking summary or contact our customer support before finalizing a purchase.

Jinko is not liable for misunderstandings that may arise from free-form conversational interactions, especially if the final booking details (dates, destinations, passenger info, etc.) were not correctly captured due to ambiguous user input or other communication issues.

Always review your booking details carefully before payment.

Bookings and Payments

Booking Process: When you find a flight option you wish to book, Jinko will guide you through the booking process, either within our mobile application interface or via the conversational platform.

You will be asked to provide required traveler information (such as full name as on government ID, date of birth, contact details, and any frequent flyer numbers or special requests if applicable) and payment information to complete the reservation.

All bookings made through Jinko are subject to acceptance and confirmation by the third-party travel provider.

This means that your reservation is not finalized until the provider (e.g., the airline or ticketing agent) confirms availability and payment.

Once your booking is successfully placed, Jinko will issue a confirmation notice containing the essential details of your trip, such as the flight itinerary, booking reference or ticket number, and price breakdown.

This booking confirmation will be sent to you via email (to the address you provided during booking) and/or via in-app notification.

It is your responsibility to provide a valid email address and to check for the confirmation.

If you do not receive a confirmation within 24 hours of making a booking, please contact Jinko customer support promptly.

Pricing and Accuracy: The price of any flight or travel service displayed on Jinko is determined by the third-party travel providers and is subject to change until your booking is completed.

Airfare prices are dynamic and can fluctuate based on availability, demand, and other factors;

as such, Jinko cannot guarantee that a quoted price will remain available for any period of time before booking.

We strive to ensure that all prices and information on our platform are accurate and up-to-date;

however, on rare occasions errors or discrepancies can occur (for example, due to rapid changes by the provider or technical issues).

If a pricing error or other material mistake is discovered after you have made a booking request, we reserve the right to correct the error.

In such cases, we will inform you as soon as possible.

Depending on the circumstances, we may offer you the choice to proceed with the booking at the correct price (if the provider agrees) or cancel the booking without penalty if the correct price is not acceptable to you.

Jinko has no obligation to honor bookings at prices that are clearly incorrect if the error was apparent (for instance, a first-class ticket mistakenly listed for $10).

We will not charge you any cancellation fee in the event of a pricing error cancellation, and any amounts already paid will be refunded if you choose not to proceed with the corrected price.

Payment: When you initiate a booking, you will be informed of the total price to pay, which typically includes the airfare (base fare), taxes, and any additional fees (such as carrier-imposed surcharges or Jinko’s service fee, if applicable).

Payment for bookings may be processed in one of two ways depending on the travel provider and the booking: (1) Agency Collection – Jinko (or its authorized payment processor) collects your payment details and charges your credit/debit card on behalf of the travel provider at the time of booking.

In this case, Jinko is acting as the agent of the provider for payment services, and your payment will be passed through to the airline or ticketing partner.

Once payment is processed by us, your transaction is considered complete and settled with the provider.

(2) Direct Provider Charge – Alternatively, in some cases the travel provider (e.g., the airline) will charge your card directly at the time of booking or at the time of travel.

For example, certain bookings might redirect you to an airline’s payment portal, or the airline might process the payment upon ticket issuance.

In both scenarios, you will be clearly informed during the booking process who is charging your payment (Jinko or the provider) and at what point the charge will occur.

Regardless of who processes the payment, your booking is not confirmed until the payment is successfully authorized and captured.

If your payment method is declined or fails, the booking request may be automatically cancelled by the provider.

Jinko assumes no liability for any loss of reservation due to payment failure, but we will attempt to notify you if a payment fails so you can try an alternate method.

Please note that some flight fares require immediate full payment at the time of booking (especially for certain promotional or discounted fares), while other bookings may allow a delayed payment or deposit.

Any upfront payment requirements or payment schedule are dictated by the provider’s policy and will be communicated to you during the booking process.

For instance, you might encounter a non-refundable fare that must be paid in full upon booking, or a fare that allows reservation without charge for a short period.

It is your responsibility to review these payment terms before confirming the booking.

Jinko is not responsible for a provider’s payment policy or any non-refundable charges; we simply relay their terms to you.

If you fail to make a required payment by a provider’s deadline (for example, if an airline allows you to hold a reservation and pay later, but you do not pay by the due date), the provider may cancel your booking, and any partial payments made might be forfeited per the provider’s rules.

Taxes and Fees: The prices quoted will include applicable taxes, and any additional fees or charges will be disclosed before you complete booking.

Depending on the flight and provider, such fees could include baggage fees, seat selection charges, or booking service fees.

Jinko will itemize known fees and taxes during checkout. Be aware that certain airlines may charge optional fees after booking (for add-ons like extra baggage, seat upgrades, etc.), which are not collected by Jinko.

You are responsible for any such optional charges if you choose to incur them.

Also note that if your payment currency differs from the currency of the fare (e.g., you’re paying in USD for a flight priced in EUR), your bank or card issuer may apply a currency exchange rate and possibly foreign transaction fees;

Jinko is not responsible for these external banking fees.

Booking Confirmation: After successful booking and payment, Jinko will provide you with a confirmation e-mail or in-app confirmation containing your itinerary and booking reference.

This serves as proof of your confirmed reservation. It is important that you review this confirmation immediately and ensure all details are correct (names of travelers, dates, destinations, etc.).

If you find any errors or discrepancies, contact Jinko support within 24 hours of booking so we can attempt to assist in correcting them (corrections after 24 hours or outside any free-cancellation period may not be possible without incurring fees).

Cancellations, Changes, and Refunds

Provider Policies Apply: All cancellations, changes (such as date or route changes, name corrections, etc.), and refund requests for bookings made through Jinko are subject to the fare rules and cancellation policies of the third-party travel provider that issued your ticket.

You do not have an automatic right to cancel or change a flight booking unless the fare conditions of your ticket or the provider’s terms allow it.

During the booking process, Jinko will display the key cancellation and refund terms associated with your selected fare (for example, whether the ticket is refundable, non-refundable, or changeable with a fee, and any deadlines for free cancellation).

By completing a booking, you are agreeing to those specific cancellation and change terms.

It is crucial that you note whether your airfare is flexible or not before you book.

Some bookings cannot be canceled or changed without penalty – for instance, many discount economy fares are fully non-refundable and non-changeable once booked – whereas other bookings may allow cancellation (often for a refund minus a fee) or free changes up until a certain time before departure.

The rules vary by fare type and airline; a fare that permits cancellation will typically come with conditions (such as a cancellation fee or a cutoff date for full refund).

Jinko has no ability to override an airline’s or provider’s stated policy.

Requests for Cancellation/Changes: If you wish to cancel or modify a booking, you should submit your request through the Jinko app interface (if the feature is available for your booking) or by contacting our customer support.

We will then work with the travel provider on your behalf to process the request.

Keep in mind that any cancellation or change will incur whatever fees or penalties the provider’s policy stipulates (for example, an airline might charge a $200 change fee for date changes, plus any difference in fare).

Jinko does not charge additional administrative fees for processing a standard cancellation or change beyond what the provider charges, unless such a fee is disclosed to you at the time of your booking or when you make the change request.

We will always let you know the total cost (e.g., airline fees and any service fee, if applicable) before finalizing a change or cancellation.

Importantly, if the fare you originally purchased is non-refundable, cancelling the ticket will generally mean you are not entitled to any refund except perhaps certain taxes (as per airline policy).

Likewise, if changes are not permitted on your ticket, we will be unable to alter your itinerary without requiring you to cancel and rebook a new ticket (incurring a loss of the original ticket value).

Refunds: If you are entitled to a refund for a canceled booking (for instance, you bought a refundable fare and you cancel within the allowed time, or the airline cancels your flight and must issue a refund), the amount of the refund and the method of refund will follow the provider’s rules.

Typically, any refund due for a credit card purchase will be processed back to the original form of payment.

The timeline for receiving your refund can vary: some airlines process refunds within a week or two, while others may take a billing cycle or longer.

Jinko will facilitate the refund process by conveying your refund request to the provider and, if the payment was processed through Jinko, by processing the refund transaction once approved by the provider.

However, please note that the actual obligation to provide a refund lies with the travel provider under their terms – Jinko’s role is to assist in obtaining that refund on your behalf.

If you encounter any difficulty obtaining a refund you believe is due, we will help you communicate with the provider, but Jinko is not liable to pay you refunds that have not been authorized by the provider.

In other words, your sole remedy for obtaining a refund (including in cases of flight cancellations or no-shows) is against the relevant travel provider, not Jinko.

Changes by Provider: Occasionally, a travel provider may significantly change or cancel your booking on their end – for example, an airline might change flight schedules, or cancel a flight due to low demand, weather, or other operational reasons.

Jinko is not responsible for such changes (since they are outside our control), but we will make reasonable efforts to inform you as soon as we are notified of a significant change or cancellation by the provider.

We will assist you in exploring available options, which may include rebooking on an alternative flight or obtaining a refund or travel credit, according to the airline’s policies.

For instance, if your flight is canceled by the airline, most airlines will offer either a rebooked flight or a full refund;

Jinko will help facilitate whichever option you choose, within what the airline allows.

Similarly, if an airline changes your itinerary (e.g., different departure time or routing), we will pass along that information and help you secure a satisfactory resolution if possible.

Please keep your contact information (email and phone number) up to date in your booking, so we or the provider can reach you promptly in such events.

No-Show Policy: If you fail to show up for a flight or segment of travel without canceling in advance, it is generally treated as a “no-show.”

No-shows are typically not eligible for refunds and may result in the cancellation of remaining segments of your itinerary (e.g., if you miss your outbound flight, the airline might cancel your return flight).

For this reason, if your plans change, we strongly advise you to cancel or notify the airline (via Jinko or directly, as instructed) before the departure to preserve any value in your ticket.

The specific consequences of a no-show are defined by the airline’s policy (many will void the ticket entirely).

Jinko is not responsible for any loss resulting from your failure to cancel in accordance with the provider’s policy.

In summary, all refunds and cancellations are handled in line with the third-party provider’s rules for your fare type.

Jinko will help you navigate the process, but we cannot alter those rules.

Always review the fare conditions before booking so you understand what flexibility (if any) you have.

If you have questions about a policy, our support team can assist prior to booking.

Personal Data and Privacy

Your privacy is important to us. In order to provide our travel search and booking services, Jinko must collect and process certain personal information about you and any travelers for whom you book.

This personal data may include, for example: your name, contact details (email, phone number, address), payment information, and travel preferences;

as well as traveler details like full name, date of birth, gender (if required for the airline), passport or ID information (if required for international travel bookings), and any special accommodations or dietary requests you choose to provide.

We use this information strictly for purposes of providing you the service – such as securing your booking with the airline or travel provider, processing payments, sending confirmations and travel updates, and offering customer support.

By using Jinko, you acknowledge and agree that we will collect, use, and share your personal information as described in our Privacy Policy.

Our Privacy Policy [outlined separately] explains in detail how we collect data, the purposes of processing, the legal rights you have, and how we safeguard your information.

We encourage you to read it carefully. In summary, Jinko will only use your personal data in accordance with applicable data protection laws and the Privacy Policy.

For example, we implement appropriate technical and organizational measures to protect your data, and we do not sell your personal data to third parties for their marketing.

We may share relevant personal information with third parties only as needed to complete your requested services – primarily, this means providing passenger information to airlines or booking partners to facilitate your flight reservation, and providing your payment details to our payment processors and the travel provider to finalize the transaction.

We may also share data with service providers who perform functions on our behalf (such as cloud hosting or customer support tools), but in all cases such providers are contractually bound to protect your information.

Traveler Information: If you provide us with personal data of other individuals (for instance, if you are booking a flight for other travelers or a group), you represent and warrant that you have obtained all necessary permissions or consents from those individuals to share their data with Jinko for the purposes of travel booking.

You further agree that any personal data you provide is accurate and up-to-date, and that you have the right to provide it to us so that we may use it to arrange travel on your behalf.

We will handle all personal data you provide in accordance with our Privacy Policy and these Terms.

If a traveler whose data was provided to us has any inquiries or requests (such as to access or delete their data), please contact us or have that person contact us directly – we will honor privacy rights as required by law.

Use in Conversational Platform: If you use our AI chatbot or conversational interface, be aware that the content of your conversation may be processed by the underlying platform (e.g., OpenAI’s ChatGPT technology) in order to generate responses.

We do not use these conversations for any purpose other than to assist with your travel requests, and we treat the information you input with care.

However, we advise you not to share sensitive personal information in an open chat beyond what is necessary for travel booking.

For example, our chatbot may ask for your travel dates and destinations, or passenger names to search flights.

It’s designed to collect only the needed details. Any personal or payment information that needs to be collected for booking will typically be entered through secure forms in the app (not through the free-form chat), to ensure security and PCI compliance.

If any personal data is handled via the chat interface, it remains subject to the same protections as described in our Privacy Policy.

Privacy Policy Reference: These Terms incorporate Jinko’s Privacy Policy by reference.

If there is any conflict between these Terms and the Privacy Policy regarding personal data usage, the Privacy Policy will govern that aspect.

By agreeing to these Terms, you are also acknowledging our Privacy Policy and consenting to the data practices it describes.

If you wish to withdraw consent or request deletion of your data, please refer to the procedures in the Privacy Policy (though note that we may still need to retain certain data if required for legal compliance or legitimate business purposes, as described therein).

Intellectual Property

All content, features, and functionality on the Jinko platform – including the mobile application design, text, graphics, logos, button icons, images, audio clips, and software, as well as the conversational AI interactions and any Jinko-generated content – are the intellectual property of Jinko Inc. or its licensors.

This includes all trademark rights in the name “Jinko” and our logos, all copyrights in the compilation of content and software code, and any patent or trade secret rights in our technology.

These materials are protected by intellectual property laws and treaties.

Except for the limited rights expressly granted to you under these Terms, Jinko and its licensors retain all right, title, and interest in and to the Jinko services and platform.

Using our services does not transfer any ownership of our intellectual property to you.

Limited License: Subject to your compliance with these Terms, Jinko grants you a limited, non-exclusive, non-transferable, revocable license to access and use our mobile app and conversational platform for the sole purpose of personal, non-commercial travel planning and booking.

This license allows you to view content on our app, interact with our chatbot, and make bookings for yourself and companions.

You may not distribute, modify, transmit, reproduce, or create derivative works from any part of the Jinko platform unless we have given you explicit written permission to do so.

You also may not reverse engineer or decompile our software, or attempt to extract source code, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

Trademarks: “Jinko” and our associated logos, slogans, or design marks are trademarks or service marks owned by Jinko Inc. You are not permitted to use these marks in any way (such as in advertising or publicity) without our prior written consent.

All other third-party names or logos that may appear on our platform (for example, airline names or logos) are the property of their respective owners and are used on Jinko’s platform solely to refer to those companies and their services.

Such use does not indicate any affiliation, sponsorship, or endorsement by those third parties.

Prohibited Uses: You agree not to remove, obscure, or alter any copyright notices, trademark symbols, or other proprietary legends appearing on the Jinko platform or printed on materials we provide (such as e-tickets or itineraries).

Any use of the Jinko platform or its content that is not expressly authorized by these Terms is prohibited.

Jinko reserves all rights not expressly granted herein.

If you have feedback or suggestions for improvement of our platform (“Feedback”), note that we may use such Feedback freely and you grant us a worldwide, perpetual license to use or incorporate your Feedback into our products or services without any obligation to you.

However, nothing in these Terms transfers ownership of your personal content or data to us;

our rights to use personal data are solely as described in the Privacy Policy and above.

Disclaimers

“As-Is” Service: Jinko provides its platform and services on an “as is” and “as available” basis, without any warranties of any kind.

While we strive to provide a high-quality, reliable service, we make no guarantees or warranties, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the platform or any content on it.

This includes, without limitation, the travel information (flight schedules, prices, availability, etc.) obtained from third-party providers.

You use Jinko at your own risk. To the fullest extent permitted under applicable law, we expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from a course of dealing or usage of trade.

We do not guarantee that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Information Accuracy: The travel data (such as flight times, availability, pricing, seat options, etc.) presented through Jinko is largely provided by the airlines and travel suppliers.

We take reasonable care to ensure this information is up-to-date and accurate, but we cannot warrant or promise that all information will always be error-free or current.

Airlines may change their schedules, seat availability may fluctuate, and prices can change suddenly – sometimes these changes may not be immediately reflected on our platform.

Jinko is not responsible for such information obtained from providers, and we cannot be held liable for any errors or omissions in the data, although we will do our best to correct any inaccuracies promptly when we become aware of them.

Similarly, any advice or automated recommendations provided by our chatbot or platform (such as suggested flights or “best options”) are for general informational purposes and do not come with a warranty of suitability for your needs.

You should exercise your own judgment when evaluating travel options.

No Warranty for Third-Party Services: Any travel services that you book via Jinko are ultimately provided by third parties (e.g., airlines, agencies, or other partners).

Jinko does not provide or operate the flights, and we do not guarantee the quality, safety, punctuality, or fitness of any third-party travel service.

We are not liable for any acts, errors, omissions, representations, breaches, or negligence of any such travel providers.

This includes, for example, situations such as an airline’s failure to operate a flight on time, cancellation of a route, overbooking of a flight, airline staff conduct, baggage handling issues, or any other aspect of the actual travel experience.

Jinko’s role is limited to facilitating your bookings; we make no warranties or representations regarding the travel arrangements you secure through our platform.

The travel provider’s own terms and warranties will apply to your transaction with them.

If you encounter a problem with the actual travel service (e.g., a flight cancellation, significant delay, or dissatisfaction with the service), your remedy lies with the provider pursuant to their terms and applicable law, not with Jinko.

Nevertheless, we will try to support you in resolving issues by providing information or assistance contacting the provider where possible.

Technical Disclaimer: Although we aim for a high availability of our platform, we do not guarantee that Jinko’s services will be available at all times or in all locations.

Outages, maintenance, or technical issues may occur. We also cannot guarantee that our mobile app or chatbot will be compatible with every device or software configuration.

Jinko is not responsible for any inability to access the service or any errors that arise from issues such as internet connectivity problems, system failures, or unauthorized access by third parties.

You are responsible for implementing sufficient security on your own devices (like using updated antivirus software) to protect against any potential harm that could arise from using an online service.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you in full.

In such cases, any warranties required by law are limited in duration to the minimum period allowed and not beyond.

Limitation of Liability

To the maximum extent permitted by law, in no event shall Jinko or its affiliates, or any of their officers, directors, employees, agents, or partners, be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit, revenue, goodwill, opportunity, or data, arising out of or in connection with your use of (or inability to use) the Jinko platform or any travel booking made through Jinko.

This limitation of liability applies regardless of the legal theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

For example, Jinko will not be liable for damages such as the cost of obtaining replacement travel arrangements, lost business or personal opportunities from missed flights, emotional distress, or any other indirect harm that may result from problems with a booking or the use of our platform.

In addition, Jinko and its affiliates are not liable for any failure or delay in performance of our obligations under these Terms if such failure or delay is due to causes beyond our reasonable control.

This includes, but is not limited to, acts of God, natural disasters, war, terrorism, civil disturbances, strikes, government actions, epidemics, technical failures, or interruptions in our services or in the services of travel providers.

Cap on Liability: If, notwithstanding the foregoing exclusions, Jinko is found to have any liability to you, our total aggregate liability for any and all claims arising from or related to the services or these Terms will be limited to a maximum amount of $100 (one hundred U.S. dollars).

This means that, to the extent we are held liable, we will at most be responsible for up to $100 in total, regardless of the number of events or claims.

If you paid any service fees to Jinko for a booking in question, we may choose to use the amount of fees you paid as an alternative cap if that amount is less than $100.

The purpose of this cap is to set an upper bound on our financial responsibility to you, which you agree is reasonable given that Jinko is an intermediary not charging you for the flight itself (other than any disclosed service fees).

Exceptions: The limitations above do not purport to limit liability that cannot be limited under law.

For example, if applicable law specifies that certain damages (like in cases of willful misconduct or personal injury) cannot be disclaimed or capped, then those specific liabilities are not waived or capped by Jinko.

In particular, nothing in these Terms shall operate so as to exclude or limit our liability for (a) death or personal injury caused by Jinko’s negligence, or (b) Jinko’s fraud or fraudulent misrepresentation, or (c) any other liability which cannot be excluded or limited under applicable law.

However, in any case where the law allows limitation, the limitations and exclusions set forth in these Terms will apply to the fullest extent permitted.

Because some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, the above limitations may not fully apply to you.

In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification: You agree that if your use of Jinko (or any actions related to your account or bookings) violates these Terms or any law, and as a result Jinko incurs any losses, damages, costs, or third-party claims, you will indemnify and hold harmless Jinko and its officers, directors, and employees from and against those losses or claims.

In other words, you will reimburse (or pay directly) any amount of money, including reasonable attorneys’ fees, that Jinko is required to pay to a third party (or in legal fees) because of your breach of these Terms, your misuse of the platform, or your violation of any law or rights of a third party.

We will notify you of any such claim and you will cooperate with us in the defense.

This indemnification obligation will survive termination of your relationship with Jinko.

Governing Law and Jurisdiction

These Terms and your use of the Jinko services will be governed by and construed in accordance with the laws of the State of California, USA, without giving effect to any conflict-of-laws principles that might result in the application of the laws of another jurisdiction.

By using Jinko, you agree that any dispute or claim arising out of or relating to these Terms or your use of the platform that cannot be resolved amicably will be subject to the exclusive jurisdiction of the state and federal courts located in California.

You consent to the personal jurisdiction of such courts for litigating any such disputes.

If you are using Jinko as a consumer (for personal use) in a jurisdiction that affords you mandatory consumer protections under local law, nothing in this Governing Law section will deprive you of the protection of those mandatory provisions of law.

However, in all cases, to the extent permitted, the laws of California will apply.

International Use: Jinko is based in the United States and primarily intended for US users, though it may be accessible worldwide.

If you access or use the platform from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

We make no representation that the services are appropriate or available in any particular location.

Regardless of your location, the governing law as stated above (California, USA) will apply to these Terms, to the extent allowed.

Changes to These Terms

Jinko reserves the right to modify or update these Terms at any time.

If we make material changes, we will post the revised Terms on our platform and update the “Effective Date” at the top.

In some cases, we may also notify you of significant changes via email or in-app notification.

Any changes to the Terms will become effective once posted, unless indicated otherwise.

Your continued use of the Jinko platform after the updated Terms take effect will constitute your acceptance of the changes.

We encourage you to review the Terms periodically to stay informed of any updates.

If you do not agree with a change, you should discontinue use of Jinko before the new Terms apply.

For any booking that was made prior to an update of the Terms, the Terms in effect at the time of your booking will generally govern that booking, unless we obtain your consent to apply the new Terms retroactively for that transaction.

(In other words, changes are usually prospective and not retroactively applied to past bookings.) If you have saved or printed a copy of these Terms, please ensure you check back for the most current version.

Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy and any additional terms explicitly agreed to (such as special conditions for a particular promotion or feature, if applicable), constitute the entire agreement between you and Jinko regarding your use of our services.

They supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remainder of the Terms will remain in full force and effect.

Any invalid or unenforceable section will be deemed modified to the limited extent necessary to make it valid and enforceable, reflecting the parties’ intent as closely as possible.

No Waiver: Jinko’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Jinko.

Assignment: You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent.

Jinko may freely assign these Terms or any rights under them to any third party, including in connection with a merger, acquisition, sale of assets, or by operation of law.

These Terms will inure to the benefit of and be binding upon each party’s successors and permitted assigns.

No Third-Party Beneficiaries: These Terms do not confer any rights or remedies on any person other than you and Jinko (and Jinko’s affiliates, where applicable).

No third party shall have the right to enforce any provision of these Terms, except as explicitly set forth.

Relationship: No joint venture, partnership, employment, or agency relationship exists between you and Jinko as a result of using our platform or agreeing to these Terms.

You act on your own behalf for your own benefit, and not as an agent for any other party when using the service.
